EverShield Terms of Use

These Terms of Use govern access to the EverShield website, the EverShield staff application, and related services. They are a working document prepared for legal review. They are not attorney-approved and are not a substitute for a custom Apple End User License Agreement. Apple’s standard EULA may apply to the app unless EverShield later configures a custom EULA in App Store Connect.

Acceptance

By using the website or app, you agree to these terms and to the Privacy Policy. If you do not agree, do not use the services.

Eligibility

The staff app is for EverShield employees and approved sales representatives. New staff accounts may remain pending until an administrator approves access. The public website is for homeowners and other visitors seeking information or a roof assessment.

Account responsibilities

Staff users are responsible for their login credentials and for information they enter about customers and properties. You must provide accurate information and notify EverShield if you believe an account has been compromised. The company administrator account cannot be deleted from the app.

Acceptable use

You may not use the services to:

• Access another person’s account without authorization
• Interfere with or disrupt the website, app, or related systems
• Upload unlawful, misleading, or infringing content
• Misrepresent your identity or affiliation with EverShield
• Use the services for any purpose other than EverShield’s intended business use

Website and app services

The website provides company information, legal pages, and forms to request a roof assessment or support. The app provides quoting, customer management, scheduling, and job-payment tools for staff. Features may change as the product develops.

Roof-assessment information

A free roof assessment is an evaluation of whether a roof appears to be a candidate for EverShield treatment. An assessment is not a guarantee that treatment is appropriate, that a roof will last a stated number of additional years, or that replacement can be avoided. Not every roof qualifies.

Quotes and estimates

Quotes and estimates are based on information available at the time, including property details, roof measurements, and site conditions. They are not a final invoice until accepted in writing under the terms provided with that quote. Pricing depends on roof size, configuration, condition, and preparation requirements.

Service scheduling

Scheduling depends on qualification, weather, access, and crew availability. EverShield may reschedule when conditions make professional application inappropriate.

Intellectual property

The EverShield name, marks, website content, and app interface are owned by EverShield or its licensors. You may not copy or reuse them except as needed to use the services or as permitted by law.

User-submitted content

If you submit photos, notes, form responses, or other content, you grant EverShield a license to use that content to evaluate a roof, provide service, and operate the business. You represent that you have the right to submit the content.

Disclaimers

The services are provided as-is except where a written manufacturer warranty later says otherwise. EverShield applies HRX Roof Protector, a Polyacrythane™ system by Armovex. Armovex provides a 15-year limited performance warranty on qualifying installations; the remedy is repair, recoat, or replacement coating material, not a full roof replacement. Registration within 30 days of installation is required. Actual roof performance varies. Typical cost comparisons such as “about 30% of a new roof” are not a guaranteed price. Third-party cost statistics, including national roof-replacement averages, are industry context and not a promise of individual savings. We do not warrant uninterrupted or error-free operation of the website or app.

Limitation of liability

To the fullest extent permitted by law, EverShield and [LEGAL ENTITY NAME] are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, arising from the website, app, assessments, or related communications. Liability for direct damages is limited to the amount you paid EverShield for the specific service giving rise to the claim, or one hundred dollars if you paid nothing, except where the law does not allow that limit.

Indemnification

You agree to indemnify EverShield against claims arising from your misuse of the services, your submitted content, or your violation of these terms, except to the extent caused by EverShield’s own misconduct.

Termination

We may suspend or terminate access if these terms are violated or if an account is disabled. Staff may delete their own app account as described at Delete Account. Provisions that should survive termination, including intellectual property, disclaimers, and limitation of liability, will survive.

Changes

We may update these terms. Continued use after an update constitutes acceptance of the revised terms. The “Last Updated” date will change when we publish a revision.

Governing law

These terms are governed by the laws of [GOVERNING LAW / STATE], without regard to conflict-of-law rules, except where applicable law requires otherwise.
